\n Judge Arthur Engoron wanted to hear directly from Donald Trump.\n <\/p>\n

\n After Trump earlier Wednesday had apparently spoken about Engoron\u2019s law clerk \u2013 in violation of the judge\u2019s gag order \u2013 Engoron\u00a0briefly paused the New York civil fraud trial testimony and\u00a0said he was\u00a0\u201cgoing to hold a hearing right now\u201d\u00a0on the matter and would call his first witness: Donald J. Trump.\n <\/p>\n

\n Engoron asked Trump if he would like to be on the witness stand. Trump didn\u2019t hesitate, pushing back his seat at the\u00a0defense\u00a0table instantly to stand and walk into the witness box.\u00a0Wearing a blue tie, pinstripe shirt and navy suit, Trump\u00a0raised his right hand, and swore to tell the truth, the whole truth and nothing but the truth.\n <\/p>\n

\n Trump\u2019s surprise appearance as a witness under questioning from the judge was an astonishing moment even in a year of unprecedented firsts for a former president who has been indicted four times and now faces the prospect of criminal trials all playing out while he runs for the White House in 2024.\n <\/p>\n

\n This episode \u2013 where Trump\u2019s alleged violation of a gag order by attacking his perceived opponents could, in theory, have led to his imprisonment \u2013 was a stark reminder of the difficulty he will face navigating his campaign rhetoric with the legal realities and constraints of the courtroom.\n <\/p>\n

\n Once Trump was on the stand,\u00a0Engoron put on his lawyer hat and launched into a calm interrogation of the former president, reading back\u00a0what Trump had told reporters outside the courtroom only hours earlier.\n <\/p>\n

\n \u201cThis judge is a very partisan judge with a person who is very partisan sitting alongside him \u2013 perhaps even much more partisan than he is,\u201d Trump had said.\n <\/p>\n

\n Before lunch, Trump\u2019s lawyers claimed his statement was not about the judge\u2019s clerk, but about Michael Cohen,\u00a0Trump\u2019s former lawyer and fixer,\u00a0the witness who had also been sitting next to the judge. It was\u00a0a claim that strained credulity, given Trump\u2019s previous attacks.\n <\/p>\n

\n But Engoron wanted to hear it directly from Trump.\n <\/p>\n

\n \u201cTo whom were you referring,\u201d Engoron asked Trump about his comments in the hallway.\n <\/p>\n

\n \u201cYou and Cohen,\u201d Trump said.\n <\/p>\n

\n \u201cAre you sure you didn\u2019t mean the person on the other side?\u201d Engoron asked, a reference to his clerk, who was still seated, keeping a straight face, just to his right.\n <\/p>\n

\n \u201cYes,\u201d I\u2019m sure,\u201d Trump responded.\n <\/p>\n

An upset Trump speaks to reporters after storming out of court<\/p>\n<\/p><\/div>\n<\/p><\/div>\n

\n During the first week of the trial, Engoron enforced a gag order barring parties from speaking about his staff, in response to a social media post from Trump attacking Engoron\u2019s clerk and showing a picture of her with Senate Majority Leader Chuck Schumer, a New York Democrat.\n <\/p>\n

\n Trump had already been fined last week $5,000 because his post hadn\u2019t been taken down from his website, something his lawyers said was in inadvertent, and warned there would be more severe penalties for additional violations \u2013 even threatening imprisonment.\n <\/p>\n

\n On Wednesday, Engoron warned Trump and his attorneys that he was protective of his staff in an \u201coverheated environment.\u201d And while the website post may have been inadvertent, he said, Trump\u2019s comments that morning were \u201cobviously intentional.\u201d\n <\/p>\n

\n \u201cI don\u2019t want anyone killed,\u201d the judge said.\n <\/p>\n

\n Engoron wasn\u2019t done yet with his questions, asking the former president whether he had referred to his clerk in the past as a partisan Democrat.\n <\/p>\n

\n \u201cI think she\u2019s very biased against us. I think we\u2019ve made that clear,\u201d Trump said, noting they had \u201cput up a picture\u201d that the judge didn\u2019t want up and then they had then taken it\u00a0down.\n <\/p>\n

\n Engoron then turned to Trump, asking whether he always referred to Cohen \u201cas Michael Cohen?\u201d\n <\/p>\n

\n Trump responded no, and his lawyers piped in to note Trump had much more derogatory ways he talked about his former lawyer and fixer.\n <\/p>\n

\n Engoron then asked whether any other lawyers wanted to question Trump. None stepped forward, and he excused his witness.\n <\/p>\n

\n Once Trump was seated, Engoron said, \u201cAs the trier of fact, I find that the witness is not credible,\u201d noting Trump\u2019s past comments about his clerk and the fact there was a barrier between the judge and Cohen in the witness box.\n <\/p>\n

\n Engoron said he was fining Trump $10,000 for his comments.\n <\/p>\n

\n The ruling prompted an objection from Trump\u2019s attorneys, who argued it couldn\u2019t be proven who Trump was referring to. They also took the opportunity to complain about the clerk\u2019s outsized role sitting beside Engoron \u2013 after\u00a0attorney\u00a0Alina Habba had already accused the clerk in the morning of making \u201ceye rolls\u201d at the Trump team\u2019s questions.\n <\/p>\n

\n \u201cI do not like having eyes rolled,\u201d Habba said. \u201cI do not like being\u00a0yelled\u00a0at by law clerks who did not earn the robe.\u201d\n <\/p>\n

\n Engoron said he would reconsider his motion, but noted that the complaints being raised were merely proving \u201cmy exact point\u201d that Trump was concerned about the clerk when he spoke.\n <\/p>\n

\n \u201cI\u2019ve reconsidered, the ruling stands,\u201d Engoron said. \u201cDon\u2019t do it again or it\u2019ll be worse.\u201d\n <\/p>\n

\n Trump did not visibly react to Engoron, staring straight ahead as the court proceedings got back underway and Cohen returned to the stand. He remained through most of the testimony with his arms folded, watching Cohen testify under cross-examination from his attorney, Cliff Robert.\n <\/p>\n

\n But as Cohen\u2019s testimony wrapped up, the former president threw up his arms alongside Habba, seated beside him, after Cohen testified that Trump had not directly told him to inflate his financial statements, contradicting his earlier testimony. (Cohen later clarified that Trump didn\u2019t ask him directly but he implied it by speaking like a \u201cmob boss.\u201d)\n <\/p>\n

\n Robert then turned back to Engoron and made a motion for a\u00a0directed verdict to\u00a0dismiss\u00a0the trial because Cohen was a key witness for the New York attorney general.\n <\/p>\n

\n \u201cDenied,\u201d Engoron immediately responded.\n <\/p>\n

‘A defeated man’: Cohen describes seeing Trump in court<\/p>\n<\/p><\/div>\n<\/p><\/div>\n

\n At that, Trump had enough, standing up and storming out of the courtroom with Cohen still on the stand.\u00a0He appeared noticeably agitated when he spoke briefly to the camera in the hallway outside the courtroom, taking no questions. \u201cWe won this trial,\u201d Trump said before leaving the hallway.\n <\/p>\n

\n But it turns out that Trump wasn\u2019t done.\u00a0When the court session concluded for the day, Trump returned to the courtroom with his attorneys, who stayed along with the judge and the attorney general\u2019s team for roughly 45 minutes.\n <\/p>\n

\n When Trump came out, he didn\u2019t divulge what was discussed behind closed doors but renewed his attack on the judge and his complaint that the trial doesn\u2019t have a jury one more time on his way out the door.\n <\/p>\n

\n \u201cThat should be the end of the case,\u201d Trump said. \u201cIf we had a jury, this\u00a0case would\u2019ve\u00a0never started, practically.\u201d\n <\/p>\n
